1. Agreement to electronic delivery
By using the Services, checking applicable boxes, or otherwise affirmatively consenting, you agree that we may provide you with any communications, agreements, disclosures, notices, and records (collectively, “Communications”) in electronic form to the email address or mobile number you provide, through your account on the Services, or by posting on our website or mobile application. You agree that electronic Communications satisfy any legal requirement that such Communications be in writing.
2. Scope of Communications
Electronic Communications may include, without limitation: (a) these Terms of Use, Privacy Policy, and policy updates; (b) marketing messages where permitted and subject to your opt-out rights; (c) service announcements, security alerts, and administrative messages; (d) responses to your inquiries; and (e) disclosures required by state or federal law relating to financial products or lead generation, when applicable. Third-party lenders with whom you choose to transact may provide separate electronic disclosures under their own consent.
3. Hardware and software requirements
To access and retain electronic Communications, you should have: (a) a device with internet access; (b) a current web browser that supports TLS 1.2 or higher; (c) a valid email account capable of receiving HTML email; (d) sufficient storage to retain Communications or a printer to print them; and (e) for mobile, a device capable of receiving SMS if you consent to text messages. We may update these requirements from time to time; material changes will be described on the Services.
4. Updating your contact information
You are responsible for keeping your email address and phone number current. You may update contact information through your account settings (if available) or by contacting [email protected]. We are not responsible for Communications that fail due to an outdated or incorrect address on your part.
5. Paper copies
You may request a paper copy of any Communication we are required by law to provide in writing. Requests should be sent to LUMEN LOAN PROCESSING, LLC, 13677 HARLOWTON AVE, JACKSONVILLE, FL 32256, Attn: Records. We may charge a reasonable fee for paper copies where permitted by law.
6. Withdrawing consent
You may withdraw consent to receive electronic Communications that are not legally required by closing your account (where available) and ceasing use of the Services, or by following unsubscribe instructions in marketing emails or SMS. Withdrawing consent may limit or prevent us from providing certain Services. Certain transactional or legally required notices may still be delivered as permitted by law.
7. ESIGN Act and UETA
You acknowledge that your electronic assent, including clicking “I agree,” checking a box, typing your name, or using a touchscreen signature where offered, constitutes your signature and intent to be bound, consistent with the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable state implementations of the Uniform Electronic Transactions Act (UETA), where applicable.
